1. Rental Vehicle. Rental Company hereby rents to Renter the following vehicle: _________________________ (the “Vehicle”). The Vehicle shall be used for lawful purposes only.
2. Term. The term of this Contract shall begin on ____________ and shall end on ____________.
3. Rental Fee. Renter shall pay to Rental Company, as rental fee for the Vehicle, the sum of ____________ per day, due at the time of rental. Rental fee payments shall be made to Rental Company at ________________________ or through electronic transfer to ________________________.
4. Insurance. Renter shall be responsible for obtaining their own insurance coverage for the rented vehicle.
5. Security Deposit. Renter shall pay to Rental Company a security deposit of ____________, due at the time of rental. The security deposit shall be returned to Renter at the end of the rental term, provided there is no damage to the Vehicle.
6. Use of Vehicle. Renter shall use the Vehicle in a careful and lawful manner and shall comply with all traffic laws. Renter shall be responsible for any damage to the Vehicle caused by Renter or Renter’s guests.
7. Rental Company’s Access. Rental Company shall have the right to access the Vehicle for the purpose of inspection, repair, or maintenance. Rental Company shall give Renter reasonable notice of such access. In the event of an emergency, Rental Company may access the Vehicle without notice.
8. Subletting. Renter shall not sublet the Vehicle or allow anyone to operate the Vehicle except Renter or the authorized drivers listed on this Contract.
9. Alterations. Renter shall not make alterations to the Vehicle without Rental Company’s prior written consent.
10. Assignment and Binding Effect. Renter shall not assign this Contract or sublet the Vehicle without Rental Company’s prior written consent. This Contract shall be binding upon and inure to the benefit of both parties, their successors and assigns.
11. Governing Law. This Contract shall be governed by and construed in accordance with the laws of the Republic of South Africa.
12. Entire Agreement. This Contract constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether oral or written.
13. Severability. If any provision of this Contract is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
14. Waiver. A party’s failure to enforce any provision of this Contract shall not be deemed a waiver of a party’s right to subsequently enforce such provision or any other provision of this Contract.
15. Notices. Any notice or communication required or permitted under this Contract shall be in writing and delivered in person, sent by registered mail, or email. Notices to Rental Company shall be sent to the address provided above, and notices to Renter shall be sent to the address provided above.
16. Return of the vehicle. Renter shall return the vehicle to the Rental Company on the date and time specified in this contract, in the same condition as when received, normal wear and tear excepted.
